There are many businesses in the country which discriminate against people under 18. They may restrict the hours in which youth may use the business or prohibit them from entering the business unless accompanied by a parent or guardian. These are not stores which have a legal justification to discriminate against youth, such as bars, or clubs. These businesses usually have such policies because young people were found to be most responsible for shoplifting, vandalizing, or rowdy behavior. These stores do not have the right to discriminate against any particular group just because a minority in that group is committing crime. There are better ways to deal with security issues in stores than to just ban an entire group of people who happen to be under a certain age. We ask these stores to consider alternative security policies that don't involve age discrimination.

  • One parent or legal guardian may escort up to 5 youths, at least one of the youths must be the child of the parent or guardian.

  • Parental or guardian escorts must maintain visual contact with all children for whom they are responsible.

  • Unescorted youth shopping prior to 6 PM on Friday and Saturday evenings must leave the mall by 6 PM or be joined by a parent or legal guardian.
  • Youth under 18 working in the mall will be allowed access without a parent or legal guardian, proof of work status will be required and they must go directly to the place of employment and must leave the mall at the conclusion of their work shift if after 6 PM on Friday and/or Saturday evenings.
  • One parent, over 18 years of age, may escort all of his/her children. Additionally, one parent or legal guardian,over 18 years of age may escort up to 3 youths, at least one of the youths must be the child of the parent or guardian.
  • Unescorted theater patrons under the age of 18 may only enter through the Food Court entrance.

  • After 5:00 p.m. youths aged seventeen and under must be accompanied by parent, guardian or relative twenty-one years or older.
  • To accommodate large, organized youth groups we have implemented a wristband procedure. Large groups of youths, especially groups with young children must check in with Public Safety to receive wristbands. This procedure will aid Public Safety by helping them return any lost children to their appropriate group leader.
  • Groups who arrive after 3 p.m. (and plan to stay after 5 p.m.) or groups with children twelve years and younger will be asked to check in at the Customer Service Center to receive their color-coded wristbands from our Public Safety Office.

16. Clifton Park Center

  • Clifton Park Center (which used to be Clifton Country Mall) as of 1/1/08 has enacted a mall curfew/escort policy. On the days of Friday and Saturday between 4:00 PM and closing. Anyone under 18 must be escorted by a parent or guardian at least 21 or over. Teens must be accompanied by the escort at all time both on interior and exterior mall property. Accepted forms of id are driver/non driver license, military I.D., passport, visa, or collage I.D. All I.D. must be valid, have a recent photo, and the date of birth. Movie patrons must use Regal Theater entrance. This policy does not apply to stores with exterior entrances.

  • Prohibits the sale of spraypaint to anyone under the age of 18. Colorado has no laws regarding this, it is a matter of store policy, as the Home Depot next door does not have such a policy.

19. Albertsons

  • Store policy prohibits the sale of non-alcoholic malt beverages to anyone under the age of 18. According to Colorado law anything containing less than 0.05% alcohol by volume is considered a non-alcoholic beverage and its purchase or possession is not restricted. This policy was clarified in a discussion with the store manager who stated that it was a store policy decision not to sell these beverages to anyone under the age of 18. Walmart on the other hand does not discriminate in this way.

20. Chuck E. Cheese's
Company policy prohibits any under the age of 18 from entering without a parent or guardian.

21. Dave & Buster's
Persons under a certain age (18 or 21, depending on location) must be accompanied by a parent or guardian (age 25 or 30, depending on location) at all times.

Age Discrimination Questionare


1. Why was the policy enacted? Was it enacted because of problems with theft, vandalism, or rowdy patrons?

2. Have you consulted the police for advice on how to handle the problem?
a. If so what advice did they give you?
b. Did you follow their advice?

3. Have you considered other non discriminatory methods for securing the store such as adding more security guards, permanently banning anyone who misbehaves, or preventing suspicious looking people from entering the store?

4. Do you think this policy would be the most effective way to deal with the problems you had? How would this policy prevent someone over 18 from going into the mall and causing trouble?

5. Were the majority of people who were causing trouble under 18?
a. If the majority of people who were causing trouble were black, Hispanic, would you consider banning all people who happen to be black or Hispanic?
b. Do you think it is fair to penalize an entire group of people based on the actions of a few people in that group?

6. Do you realize how much business you will lose from not allowing people under 18 into the store? Teens were projected to spend $169 billion in 2004, according to a study by Teenage Research Unlimited (TRU), the nation’s premier market-research firm focusing on the teen market. Does that loss of money concern you?
